Internet Snitches Hook Up With Buck Passing Cops and Incompetent Mental Health ‘Professionals’ to Steal a Marine’s Freedom

Good news here folks, I have not talked to John Whitehead of Rutherford yet but this was a surprise.
I used the above quote to my total surprise the attorney’s had gone to court just to ask for Brandon to be transferred and the judge just threw the case out. It does not get better than that.
I have no source for this, but my intuition is that ‘higher authorities’ got wise to the Mayberry cops and mental health people going nuts here and decided to nip the damage in the bud.
Personally I think the arresting Goobers, mental health people and the first judge should spend a month under observation themselves as a proven threat to the public.
So our congrats go out to the Raub family for not having to go through weeks of mental anguish over this abuse, and to the Rutherford Institute for being Johnny on the Spot for Cpl. Raub.
Earlier today I learned more about what can only be described as a law enforcement three ring circus. Internet complaints came into the FBI about Brandon’s Facebook postings, which the FBI claimed they have to look into. You all savior that open back door for a moment. A handful of people can get together and trigger something like this and sic the Goobers on you.
Following a one-hour hearing, Prince George County Circuit Judge W. Allan Sharrett declared that the petition seeking to commit Raub for a month “is so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy.”
Folks. There is no bigger slap down to all the law enforcement, the first judge, and the Goober mental health people that signed him over to observation. It’s like they all decided to:
“Let’s just trash the reputation of law enforcement today to show Janet Napolitano of Homeland Security that we are showing these Vets with these Founding Fathers conspiracy theories that they are for child’s books, not for adults.”
Then it appears the highly paid secret service agents just tagged along for an easy day to watch, like they have nothing better to do with their time. I suspect their procedures protocols will get a little looking into on this.
The FBI and Secret Service are now claiming that they ‘had nothing to do that’, Raub being handcuffed and taken away, that the FBI doesn’t ‘make determinations like that’.
‘When we left we had not arrested him, we had not placed our hands on him, we did not detain him and we did not charge him.”
Said Secret Service Agent Brian Leary, “The Secret Service assisted the FBI with the interview. He was not arrested by the Secret Service. The Secret Service will continue to monitor the situation. We have no further comment at this time.”
For our older readers, can you read between the lines on the back pedaling here? Do you see how they are getting on the record that they left before Raub was taken away, but are not volunteering anything about what their opinion of Raub was, which begs the question why did they go out there in the first place.
So I smell a rat here. Why are all these people needed to ‘help with an interview’, and then conveniently take off before the Mayberry cops make the call (with no other law enforcement witnesses) and the FBI and SS are off the hook for interceding and saying, “Hey, wait just a minute here, we have not seen any dangerous behavior.”
Did the Chesterfield cops tell those guys to scoot so they could run Raub over to a friendly mental health guy who would commit him for thirty days and the alphabet boys would not minor reports to fill out???
As VT expected yesterday the buck passing on this bogus case was sure to happen. The Chesterfield Police Department had said previously that the situation was an FBI matter and we were just there to assist them…(from their statement).
Chesterfield Police assisted federal authorities in their efforts to interview Brandon J. Raub on Thursday, Aug. 16. After speaking to Raub, officers believed him to be in need of further evaluation.
Chesterfield officers at the scene contacted Chesterfield Mental Health Crisis Intervention. Crisis workers recommended that police take Raub into custody and bring him in for evaluation.
Chesterfield police took Raub into custody for evaluation in accordance with Virginia State Code § 37.2-808 Emergency custody. Raub was placed in handcuffs after he resisted officers’ attempts to take him into custody.
Raub was evaluated by a Chesterfield mental health official, who determined that he should be held under a temporary [detention] order and transported to John Randolph Medical Center for additional evaluation. Raub was not arrested and he faces no criminal charges in Chesterfield.

The Virginia statute states that a magistrate “shall issue, upon the sworn petition of any responsible person, treating physician, or upon his own motion, an emergency custody order when he has probable cause to believe that any person
(i) has a mental illness and that there exists a substantial likelihood that, as a result of mental illness, the person will, in the near future, (a) cause serious physical harm to himself or others as evidenced by recent behavior causing, attempting, or threatening harm and other relevant information, if any, or (b) suffer serious harm due to his lack of capacity to protect himself from harm or to provide for his basic human needs,
(ii) is in need of hospitalization or treatment, and (iii) is unwilling to volunteer or incapable of volunteering for hospitalization or treatment.”
It should be noted that the authority on whether or not Raub displayed signs of mental illness lies with the trained Chesterfield mental health official or officials who evaluated him in person.

CHESTERFIELD, VA— In an unexpected ruling handed down today by Circuit Court Judge Allan Sharrett, the judge dismissed the government’s case against Brandon Raub, the Marine who was arrested by local police and FBI agents, detained in a psychiatric ward and forced to undergo psychological evaluations based solely on the controversial nature of lines from song lyrics, political messages and virtual card games which he posted to his private Facebook page.
Judge Sharrett dismissed the petition for involuntary commitment on the grounds that the petition “is so devoid of any factual allegations that it could not be reasonably expected to give rise to a case or controversy.” Raub is expected to be released immediately.
“This is a great victory for the First Amendment and the rule of law,” said John W. Whitehead, president of The Rutherford Institute. “
Brandon Raub was arrested with no warning, targeted for doing nothing more than speaking out against the government, detained against his will, and isolated from his family, friends and attorneys. These are the kinds of things that take place in totalitarian societies. Today, at least, Judge Allan Sharrett proved that justice can still prevail in America.
Brandon Raub, a former Marine who has served tours in Iraq and Afghanistan, was detained by FBI agents and police officers at his home in Chesterfield County based upon the nature of content posted to his Facebook page in recent months. Like many Facebook users, Raub uses his Facebook page to post song lyrics and air his political opinions, as well as engage in virtual online games with other users.
On Thursday, August 16, 2012, police and FBI agents arrived at Raub’s home, asking to speak with him about his Facebook posts. They did not provide Raub with a search warrant.
Raub was cooperative and agreed to speak with them. Without providing any explanation, levying any charges against Raub or reading him his rights, law enforcement officials then handcuffed Raub and transported him first to the police headquarters, then to John Randolph Medical Center, where he was held against his will due to alleged concerns that his Facebook posts were “terrorist in nature.” Outraged onlookers filmed the arrest and posted the footage to YouTube.
In a hearing before Special Justice Walter Douglas Stokes on August 20, government officials again pointed to Raub’s Facebook posts as the sole reason for their concern and for his continued incarceration.
Ignoring Raub’s explanations about the fact that the FB posts were being read out of context and his attorney’s First Amendment defense, Stokes sentenced the former Marine to up to 30 days’ further confinement in a psychiatric ward and signed a court order for Raub’s involuntary admission to the Veterans Hospital in Salem.
In coming to Raub’s defense, attorneys for The Rutherford Institute challenged the actions of Chesterfield County, Va. as procedurally improper, legally unjustified, and in violation of Raub’s First Amendment rights.

Law enforcement seems to have lost it’s mind here folks. There is already getting bogus resisting arrest report.
While the FBI has used the term ‘terrorist in nature’ to describe their reason for picking him up, they are ducking to explain what exactly Brandon had posted qualified for that treatment.
That is a strong indication they want to keep their options open. This alone smells like a rat as they are obligated to disclose their probable cause. I would not be surprised to see a big push for an FBI professional ethics investigation here, the sooner the better.
I think it may be time to take a look at whether the FBI is really the best agency to use in such situations. They just don’t seem to have the skill sets to do it properly. And the ‘veteran bogeyman climate’ that has been created by Homeland Security also needs a good airing and some changes.

There is evil going on all around the world. The United States was meant to lead the charge against injustice, but through our example not our force. People do not respond to having liberty and freedom forced on them.

Force is not the way because liberty is a powerful concept. The idea that men can govern themselves is the basis for every just form of government.

The Bill of Rights is being systematically dismantled. Men have spilled their blood for those rights.
Your sons and daughters, your brothers and sisters, and Americas best young men and women are losing their limbs. They are losing their lives. They are losing the hearts. They do not know why they are fighting. They are killing. And they do not know why.

Rutherford picks up the Brandon Raub case
The Rutherford Institute has come to the defense of a former Marine, 26-year-old Brandon Raub, who was arrested, detained indefinitely in a psych ward and forced to undergo psychological evaluations based solely on the controversial nature of lines from song lyrics, political messages and virtual card games which he posted to his private Facebook page.
Although the FBI and Chesterfield County police have not charged Brandon Raub, a resident of Chesterfield County, Va., with committing any crime, they arrested Raub on Thursday, August 16, 2012, and transported him to John Randolph Medical Center, where he was held against his will due to alleged concerns that his Facebook (FB) posts were controversial and “terrorist in nature.”
In a hearing held at the hospital, government officials disregarded Raub’s explanation that the Facebook posts were being interpreted out of context, sentencing him up to 30 days’ further confinement in a VA psych ward.
In coming to Raub’s defense, Rutherford Institute attorneys are challenging Raub’s arrest and forcible detention, as well as the government’s overt Facebook surveillance and violation of Raub’s First Amendment rights.
“For government officials to not only arrest Brandon Raub for doing nothing more than exercising his First Amendment rights but to actually force him to undergo psychological evaluations and detain him against his will goes against every constitutional principle this country was founded upon. This should be a wake-up call to Americans that the police state is here,” said John W. Whitehead, president of The Rutherford Institute.
“Brandon Raub is no different from the majority of Americans who use their private Facebook pages to post a variety of content, ranging from song lyrics and political hyperbole to trash talking their neighbors, friends and government leaders.”
