Ms. Francis was born with a serious, life threatening heart defect and Jessica has undergone 4 major heart surgeries. She was awarded from the Oakland, California Veterans Affairs Regional Office DIC benefits for the death and loss of her father who was a three war, decorated naval veteran for service connected cause of death.
The Los Angeles Regional Veterans Affairs Office who was given the responsibility to administer payment of the award granted by the board of veterans appeals, for DIC benefits for Miss Jessica Francis, instead of paying Miss Francis the Veterans Affairs violated the privacy act by using Jessica’s Appeal ID Number and contacted the divorced spouse of the deceased veteran and paid the divorced spouse the DIC benefits awarded to Jessica and paid the divorced spouse by using Jessica’s Appeal ID Number and social security number.
According to Veteran’s Affairs regulations, divorced spouses are not entitled to DIC benefits. That is why it is erroneous to have paid the divorced spouse of Jessica’s father the benefits because the certified copy of the death certificate from the State of California Vital Statistics certified that the veteran was divorced at the time of his death.
The divorced spouse was barred from appealing or requesting benefits by the board of veteran’s appeals. That is why the office of the Inspector General is investigating the payment of DIC benefits to the divorced spouse. After the investigation they have stopped paying the divorced spouse DIC benefits and the Los Angeles Veterans Affairs Regional Office has contacted Jessica Francis that she is the Payee 11.
The board of Veterans Appeals Chairman verified that they contacted the privacy act person and that the appeal was awarded to Jessica Francis. However the Los Angeles VA Regional Office continues to refuse to comply with a Federal Court order to pay Ms. Jessica Francis.
The Los Angeles Police Department (Wilshire Division) has filed this matter as a financial crime.
