Double Standard on Records Release

The VA is like a two headed snake on records

As mentioned in my article about illegally withheld records with the use of a rubber stamp, the VA has two different sides 1. The Adjudications side , which decides cases and the Medical side that treats you.

When the Adjudication side used the Rubber Stamp to deny me and my service represenatives the records medical records that they used to foul up my claim, the VA’s medical side under the Freedom of Information Act complied with the law and gave me copies of all of my medical records. They did this by the book, they told me I couldn’t get my records that day and that a Board of doctors would have to review the records in oder to see if there was any thing in my records that would upset me as some of these records were Phyc records.

After a three day wait I went back to the VA Outpatient Clinic and was given a letter stating that the Board of doctors had reviewed my records and there was nothing that I couldn’t have. i then paid for the copies and have kept the letter from the clinic and the copy of these records.

After i finally got the copies of my records from the VA adjudication side or Regional Office, I compared these stamped records that had been denied me for 23 years with the copy of records given me under the Freedom of information Act. Surprise the Phyc records that had been denied matched the records I had been given by the medical side of the VA. the stamp was put on my adjudication records at the sametime that the medical side said there was nothing that I couldn’t see.

So why did the VA use a double standard? Simple by illegally withholding the records on my nerves, my service reps and I couldn’t see the information,ie the records that the adjudicators were using to deny the claim.

It’s ironic that one side of the VA did things right and by the law, namely the medical side and the other side operated outside the law and illegally withheld the records and lied about it.

Don’t ever think that you can trust the VA do do it right, make them.

Good luck to all vets P40Bob
