Veteran Files Military Discrimination Lawsuit Against State of Nevada

What: A lawsuit was filed yesterday by the Department of Justice against the Office of the State Controller of Nevada alleging discrimination based upon military service. The lawsuit was filed on behalf of U.S. Army Reserve Colonel Arthur Ingram, who was employed as the state’s chief deputy controller in June 2003 when called to active duty.

Upon being honorably discharged in April 2008, Ingram was offered employment with the state at a decreased salary and status than that which he previously held. After Ingram filed a complaint alleging a violation of his rights under the Uniformed Services Employment and Reemployment Rights Act (USERRA), the state withdrew their offer of employment and backdated his termination.       The state’s alleged failure to reemploy Ingram upon his return from active duty marks a violation of USERRA, which requires that civilian employers reemploy returning servicemembers in positions of like pay, status, and benefits to the positions they would have held had their employment not been interrupted by military duty.
