Even though the DVA has its’ own faults, you have to wonder what else could be contributing to the 1.1+ million claims backlog, that is crippling the system.
A LARGE part of this is the doctors who conduct the exams.
I believe that a large part of the backlog stems from doctors who are on a vendetta to disallow the Veteran a rating, albeit original or increase. WHY they do this is BAFFLING to me, but as my file shows, it IS deliberate.
Case in Point:
In 2007, the Board of Veteran Appeals had ordered the RO to schedule an appointment with an Orthopedic doctor, being that my problems are Ortho based.
What the RO instead does, is schedule a C&P exam with a doctor who may have knowledge in skeletal structure, but possesses virtually no to very little knowledge on Ortho/Neuro, including “Cause and Effect” on Ortho to Neuro .
Anyway, I cooperated and attended this exam in April 2009.
The C&P doctor did not seem friendly in the least, so I kept my mouth shut, and didn’t volunteer any additional information that, as you may be aware, can and will be used against you. I DID ask pertinent questions to give the examiner an idea that I wasn’t a dolt. The exam went, as I thought, ‘well’.
Around 2-3 weeks later, this (so called) doctor, writes up the Opinion from Hell, which included a personal note stating that she was puzzled on how I was awarded a disability rating in the first place?! I was FLOORED!
This deliberate questioning of my being disabled since 1976, when I clearly had a surgical pin penetrating my joint space at that time, either shows stupidity on the examiners part, OR the examiner was deliberately trying to get me removed from the VA roles, as not being as disabled as I claim. WHY would anyone do this? Is there a conspiracy to throw Veterans who are truly disabled, out of the system?
My blog shows how a well respected doctor says that the VA doctor has to follow VA guidelines. The questions that you have to ponder…
- Are there a guidelines in place to riddle a Veterans claims file with so many misleading defaming comments against the Veteran?
- If so, aren’t these opinions considered as Malicious Intent? OR…
- Are these doctors just not knowledgeable enough to render an Opinion, in regard to certain ailments?
- Are doctors under a *Quota Bonus* to write up a negative review, like the RO rater is under a Quota Bonus to resolve so many claims withing so much time?
- Are these doctors committing Libel, being that many people in the DVA are reviewing your records, and view the doctors statement as true and accurate. (see: Libel @ “c” & “2”)
- When you consider that guidelines are in place to discredit a Veteran and his claim, are doctors committing Defamation of (Veterans’) Character? (eg: Veteran filing a fictitious claim, due to past opinions rendered)
