On March 16, 2010, the ACLU of Southern California filed a lawsuit against Donna Beiter, executive director of the VA Greater Los Angeles healthcare system, along with her chief of police, Ronald Mathis, for Viewpoint Discrimination (censorship) after they ordered the VA police to issue false arrest citations against me, and removed the American Flag during our Sunday Rally protests.
On May 26, 2011, Judge S. James Otero of the United States District Court rendered his decision, ruling in my favor: “Plaintiff’s First Amendment right was violated as a matter of law when Defendants (Beiter and Mathis) committed impermissible viewpoint discrimination.” …. “Therefore, Defendants’ selective enforcement was an effort to suppress the Plaintiff’s activity due to disagreement with his view.”
In sum, the Defendants censored my free speech and violated my Constitutional Right under the First Amendment. This is a federal crime: “Federal Statute18 USC Section 242 makes it a crime for any person acting under color of law, statute, ordinance, regulation, or custom to willfully deprive or cause to be deprived from any person those rights, privileges, or immunities secured or protected by the Constitution and laws of the U.S.”
The foregoing notwithstanding, both Defendants are still employed by the U.S. Government and operating under the color of law in their official capacities at the largest VA in the nation. This is because there has been no enforcement of Federal Statute 18 USC Section 242, which calls for punishment carrying a fine or imprisonment of up to one year, or both.
Not only did Defendants Beiter and Mathis violate my Constitutional Right, but they also violated their own Oath of Office that requires them to support and defend the U.S. Constitution, and both should be immediately terminated from public employment and sentenced to federal prison.
General Eric K. Shinseki, Secretary of the Department of Veterans Affairs has been notified that he has two federal criminals running the largest VA in the nation, but he remains silent. No surprise there.
Think about it — there are two federal criminals running the largest VA in the nation. Last week there was a Veteran suicide inside the VA and under the “leadership” of Defendants Beiter and Mathis, they refused to offer shelter for a homeless Female Veteran and the VA police were ordered to arrest her if she returned on the premises which was deeded exclusively for disabled and disadvantaged Veterans.
A month ago, a Veteran was murdered on the VA grounds and the murderer is still at large.
As most of us have learned, California’s Unemployment Rate has risen to 12.1% for the month of August, as 2.2 million residents are without jobs. That’s 400,000 more than the entire population of the State of New Mexico.
Surely, out of 2.2 million unemployed California residents, there are two honest, competent, and responsible individuals who would give anything to serve the men and women who have defended our nation.
Secretary Shinseki refuses to take action in spite of these two who were adjudicated in U.S. Court for committing a federal crime, in addition to refusing to care for a homeless Female Veteran — and ordered VA police to arrest her if she came back inside the VA.
Moreover, Congressman Waxman and Senator Feinstein remain silent. No surprise there, either.
It’s time for President Obama to fire General Shinseki and appoint a new Secretary of Veterans Affairs who will come in and clean house at the most corrupt VA in the nation.
And it’s time to have FBI and Congressional Investigations as to why Cong. Waxman and Sen. Feinstein have failed in their fiduciary responsibility to protect Veterans land and to ensure quality shelter and care for those in need.
Show up tomorrow and speak out about the crime and corruption, and demand the removal of the two federal criminals who are running the largest VA in the nation.
